1. Agreement to Terms

By accessing or using Trade Analytics ("the Service"), operated by WealthArtist ("Company", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

The Service is accessible at ta.wealthartist.com.

2. Description of Service

Trade Analytics is a professional trade journaling and analytics platform for MetaTrader 5 (MT5) users. The Service provides:

• Automated trade ingestion from MT5 accounts
• Performance analytics and portfolio management
• Trade journaling with notes and tagging
• Multi-account portfolio tracking
• Email notifications and alerts
• Data export capabilities

The Service is a journaling and analytics tool only. It does not execute trades, provide financial advice, or manage your trading capital. All trading decisions remain solely your responsibility.

3. Account Registration

• You must provide a valid email address and create a secure password to register.
• You must be at least 18 years of age to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• Registration requires acceptance of our Privacy Policy in compliance with GDPR.

4. Account Sharing

You may share access to specific trading accounts with other registered users of the Service. When sharing:

• You control the level of access granted (view-only or edit permissions)
• You are responsible for managing who has access to your data
• You can revoke shared access at any time
• Shared users can only see data for the specific accounts you share, not your entire profile

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers connected to it
• Use automated systems (bots, scrapers) to access the Service beyond our provided APIs
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your API keys or account credentials with unauthorized parties
• Abuse rate limits or attempt denial-of-service attacks

6. MT5 Connection & Data

• You are responsible for providing valid MT5 credentials for trade ingestion.
• We store MT5 connection credentials securely with encryption.
• We access your MT5 account read-only to retrieve trade data. The Service never places, modifies, or closes trades.
• Data synchronization frequency and availability depend on your MT5 broker's server status.
• We are not responsible for data discrepancies caused by broker server issues.

7. Intellectual Property

• The Service, including its design, code, features, and documentation, is owned by WealthArtist.
• Your trading data remains your property. We claim no ownership over your trade data, notes, or analytics.
• You grant us a limited license to process your data solely for providing the Service.
• The "WealthArtist" and "Trade Analytics" names and logos are trademarks of WealthArtist.

8. Data Protection & Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data in compliance with GDPR and other applicable regulations.

You have the right to export or delete all of your data at any time through the Settings page.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• We do not warrant the accuracy, completeness, or reliability of any analytics or metrics.
• The Service is not financial advice. Trading involves significant risk of loss.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEALTHARTIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Service Modifications & Termination

• We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
• We may terminate or suspend your account for violation of these Terms.
• You may delete your account at any time through the Settings page, which permanently removes all your data.
• Upon termination, we will delete your data in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.

13. Changes to Terms

We reserve the right to update these Terms at any time. We will notify registered users of material changes via email or in-app notification at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
